Rivers State: Asari’s Sister Drags Attorney-General To Court…Wants Hon. Justice Agumagu Sacked

PETER AGUMAGUBoma Goodhead, the younger sister to the leader of the Niger Delta Peoples Volunteer Force (NDPVF), Alhaji Mujahid Asari-Dokubo has instituted a legal suit before a Federal High Court in Port Harcourt against the Attorney General and Commissioner for Justice, Rivers State, Worgu Boms, Esq over the appointment of Hon. Justice P.N.C Agumagu as the Acting Chief Judge of Rivers State.

Boma Goodhead with two others namely: Ajenyanate Samuel and the Incorporated Trustees of Kengema Unity Forum in a suit No. FHC/PHC/CS/358/2013 described the appointment of Justice Agumagu as “unconstitutional”.

The trio in their originating summons through their counsel, T.A. Dick Esq prayed the court to direct the acting Chief Judge, Hon. Justice Agumagu to immediately vacate his office to pave way for the most senior judge of the state High Court, Hon. Justice Daisy Okocha to take charge.

According to the plaintiffs, the appointment of Justice Agumagu was against Section 271 (4) of the constitution of the Federal Republic of Nigeria.

They submitted that if the purported unconstitutional appointment and swearing is not challenged and stopped, Hon. Justice Agumagu would continue to “unconstitutionally carrying out the duties of the acting Chief Judge of the Rivers State High Court which entail assigning cases, expending the judiciary budget, general administration of the Rivers State Judiciary including transfer and posting of Judges  and Magistrates, etc which will seriously affect the interest of the plaintiffs in no small measure”.

The counsel to the plaintiffs, Barr. Dick argued that, if the Governor’s actions are geared towards mutilating or tearing the constitutions into shreds, it is necessary for the court to intervene and to prevent such unconstitutional acts in the future. ###
