Man 35 Docked For Rape

A 35 year old man and others now at large is standing trial before presiding Chief Magistrate E. C. Woke for rape on charge No PMC/1410c/12.
On count one, the said accused person and others now at large were said to have on June 30, 2012, at Urualla Waterfront, Diobu, Port Harcourt in the Port Harcourt Magisterial District, conspired together to commit felony to wit: rape and thereby committed an offence punishable under section 516A (a) of the criminal code Cap 37 Vol. II, laws of Rivers State of Nigeria 1999.
On count two, the accused person and others now at large were also said to have on the same date and place in the aforesaid magisterial district had unlawful carnal knowledge of one Blessing Emesie, aged l7, without her consent and thereby committed an offence punishable under Section 358 of the Criminal Code Cap 38 Vol. II Laws of Rivers State of Nigeria 1999.
After reading the charges to the accused person, the presiding magistrate ordered that the case file of the accused person be forwarded to the Director of Public Prosecutions, DPP, for legal advice. Meanwhile, he also ordered that the accused person be remanded in prison custody and adjourned the case to August 27, 2012, pending the DPP’s advise. ###
